A Termination of Tenancy Agreement is between a landlord and tenant, whereby the
landlord and the tenant mutually agree to terminate an existing tenancy agreement.
This Agreement requires the tenant to deliver vacant possession of the rental premises
to the landlord by a certain date. In addition, the original tenancy agreement between
the parties can be attached under "Schedule A" of this document. This Agreement
could be used by individuals or small businesses that want to terminate a lease before
its term expires.
TERMINATION OF TENANCY AGREEMENT
THIS TERMINATION OF TENANCY AGREEMENT (the “Agreement”) is made this
____ day of _____________, 20___, [Instruction: insert date] by and between
_________________ [Instruction: insert the name of the landlord] (the “Landlord”) and
_______________ [Instruction: insert the name of the tenant] (the “Tenant”).
WHEREAS, Landlord and Tenant entered into a Tenancy Agreement dated the ____ day

AND WHEREAS, Landlord and Tenant are desirous to terminate and cancel the Tenancy
Agreement;
THEREFORE Landlord and Tenant hereby acknowledge and agree as follows:
1. The Tenancy Agreement dated the ____ day of __________, ______ [Instruction: insert
date] and attached hereto as Schedule “A,” is hereby terminated and cancelled by Landlord and
Tenant effective the ____ day of __________, ________. [Instruction: insert date] [Comment:

2. Tenant agrees that it shall release and vacate the rental premises known municipally as

of days] days of the execution of this Agreement by Landlord and Tenant.
3. Tenant agrees that it shall deliver the Premises to Landlord free and clear of debris and
garbage and in a condition similar to that at the time of the commencement of the Tenancy
Agreement, reasonable wear and tear expected.
4. Landlord and Tenant hereby agree to release and forever discharge each other, their heirs,
successors, and assigns, from any and all claims and/or causes of action of any nature or kind
whatsoever in connection with the Tenancy Agreement and the Premises.
5. This Agreement shall be binding upon Landlord and Tenant’s heirs, representatives,
successors, and assigns.
