Horseback Riding Release and Waiver Agreement

This is a legal instrument that acts to terminate any legal liability between the releasor and the releasee(s) arising from horseback riding. This document protects the releasor from any claims the releasee(s) may have if they are injured during horseback riding. This document contains standard language that are commonly used in releases; however, additional language may be added to suit the needs of the user. Use this form if a business provides horseback riding services and wants to protect itself against claims in case their customers get injured.

This is a legal instrument that acts to terminate any legal liability between the releasor

and the releasee(s) arising from horseback riding. This document protects the releasor

from any claims the releasee(s) may have if they are injured during horseback riding.

This document contains standard language that are commonly used in releases;

however, additional language may be added to suit the needs of the user. Use this form

if a business provides horseback riding services and wants to protect itself against

claims in case their customers get injured.

HORSEBACK RIDING RELEASE AND WAIVER AGREEMENT



This Release and Waiver (the “Release”) is voluntarily and knowingly entered into by the

undersigned Participant and its owners, employees, agents, volunteers, insurers, representatives,

directors and officers (hereinafter, collectively referred to as the "Provider").



In consideration of being allowed to participate in the horseback ride at

__________________________ [GIVE LOCATION OF THE RIDE] on ____________,

201___ [DATE OF THE RIDE], the Participant for himself/herself and his/her family,

Participant's heirs, personal representatives or assigns, hereby acknowledge the risks of injury or

damage (to property, personal injury and/or death) involved in participating in the horseback

ride.



The Participant hereby understands that horse riding involves significant risk and acknowledges

that its participation in horseback riding is purely voluntary. The Participant assumes full

responsibility for itself and its family, for any bodily injury, accident, illness, paralysis, death,

loss of personal property and expenses thereof as a result of any accident which may occur while

participating in the horseback ride. The Participant further agrees to abide by all safety

instructions, and to wear any safety equipment provided on the horseback ride while

participating in the activity.



Participant itself and on behalf of its family hereby warrants and represents that neither the

Participant nor his family members have any medical problems that might interfere with

Participant’s participation in the horse riding.



The Participant itself and on behalf of its family, its heirs, personal representatives, or assigns,

hereby completely release, acquit and forever release and discharge, the Provider its successors,

personal representatives, principals, directors, officers, agents, employees, and assigns

(“Releases”) from any and all actions, claims, demands, obligations, causes of action, damages,

costs, loss of services, expenses, legal fees and compensation of any nature whatsoever on

account of or in any way growing out of, or which in the future may result from, property

damage, bodily and personal injury, illness, paralysis, and death to the Participant, its minor

children, personal representatives or assigns, as a result of participation in the horseback ride.



This Release includes, but is not limited to, all claims or causes of action whether based on a tort,

contract, or any other theory of recovery, which the Participant now has or which may hereafter

accrue or may otherwise be acquired on account of or may in anyway grow out of any

recreational activities including, but not limited to, any and all claims for emotional distress, loss

of consortium, loss of companionship, loss of income, bodily or personal injury to Participant, or

members of Participant's family, or any wrongful death claim or punitive damage or any other

claim of Participant's representatives or heirs or assigns which have resulted or may result from

the activities, acts, omissions, or negligence of Provider.



{Instruction: Regardless of the above language, most or all courts will NOT waive liability for

Intentional bad acts. In addition, damages resulting from reckless and/or grossly negligent

acts may possibly also be seen by a court as not waived by this or any other Waiver, as

allowing these "worse-than-negligent" acts to go uncompensated is usually seen by courts as

violating public policy.}



It is agreed that this Release and its provisions shall be governed by the laws of the State of

____________________.



This Release shall not be canceled, modified, or changed in any manner except by the written

agreement of Provider and Participant.



The invalidity of any provision of this Release shall not affect the validity of the remaining

provisions.



THE PARTICIPANT HAS READ AND FULLY UNDERSTANDS THIS RELEASE WHICH

MUST BE COMPLETELY READ AND AGREED TO AND SUBMITTED BEFORE

PARTICIPATION IN THE HORSE RIDING.

{Instruction: If parent or legal guardian is signing on behalf of a minor, then name and

relationship to the minor should be included, and should look something like, "John Smith,

legal guardian, on behalf of Susan Jones, a minor."}



{Instruction and WARNING: If rider is a minor, a parent or legal guardian MUST sign in

order to give any validity to this Waiver. If a non-guardian (for example, a Scout Leader, a

teacher, a camp counselor, etc) signs, a court will almost certainly find that the waiver is NOT

valid and is not legally enforceable. Therefore, it is strongly suggested that if any minors are

expected to participate, these Waivers be sent to the parent/guardian far enough in advance to

allow for a signature and return of the Waiver.}



{Instruction: It is strongly suggested that the age of participants be verified in advance,

through drivers' licenses or state IDs, if it is even remotely possible that they are actually

minors.}
