This document outlines a company's policy regarding the employees' receipt of gifts

during the course of employment. The policy's main goal is to avoid a conflict of interest

and maintain impartiality at all times in the workplace. However, the policy outlines gift

exceptions which employees can keep, such as small gifts received in trade shows,

thank you cards, food, beverages and other small benefits. This document should be

used by small businesses and other entities that wish to maintain impartiality in the

workplace by providing employees with this gift policy.

Company Gift/Gratuity Policy

Our company's gift policy is to not accept any gifts, with a goal of avoiding even the

appearance of bias or undue influence. To avoid a conflict of interest, the appearance of a

conflict of interest, or the need for our employees to examine the ethics of acceptance,

our company and its employees do not accept gifts from vendors, suppliers, customers,

potential employees, potential vendors or suppliers, or any other individual or

organization, under any circumstances.

Our code of conduct requires that all employees demonstrate our organization’s

commitment to treating all people and organizations, with which we come into contact or

conduct business, impartially. Employees of ___________ [NAME OF COMPANY]

demonstrate the highest standards of ethics and conduct. Employees practice and

demonstrate equal treatment, unbiased professionalism, and non-discriminatory actions in

relation to all vendors, suppliers, customers, employees, potential employees, potential

vendors or suppliers, and any other individual or organization.

This policy takes the place of any earlier policy and is effective: __________ ___,

201___. All employees must acknowledge that they have received and understand the

company gift policy.

This policy is supplemental to other company codes of conduct, ethics, standards, values,

and policies in the employee handbook and in other company documents.

If any employee has questions about and /or needs clarification of any aspect of this

policy, the employee should check with their supervisor. If the supervisor is uncertain,

Human Resources is the arbiter of the gift policy to ensure consistent employee treatment

across the company.

Any exceptions to the gift policy may be made only with the WRITTEN permission of

______________ [PROVIDE NAME OF PERSON(S) OR OFFICE WITH THE

AUTHORITY TO GRANT EXCEPTIONS.]. Employees are reminded that this policy

is of the highest importance to this company, and any violation may lead to significant

negative consequences, which may include suspension and/or termination. Employees

are encouraged to discuss any existing or potential situations with Human Resources or

their supervisors, to ensure that employees act in a manner consistent with this policy,

and consistent with our commitment to conduct business in an ethical manner.

Employees must acknowledge receiving this policy by signing one copy at the bottom

and returning it to a supervisor within ____ ( ) days of receiving it. The other copy

should be retained by employees with their work records. Additional copies are

available--if needed by employees--through their supervisors or Human Resource.

This company places a high value on honesty and integrity. Therefore employees are

responsible for reporting actual and potential issues they are faced with, AND ALSO are

responsible for reporting actual or possible violations that they observe (by other

employees). If an employee does (or reasonably should) believe there is a violation of

this company's policy, but that employee does not then report it, that employee may be

subject to significant workplace consequences, which can include suspension or

termination. All employees reporting of suspected policy violations will be held in the

strictest confidence to the maximum amount permitted by law.



Company Gift Policy (or No-Gift Policy) Standards and Requirements

As one effort to demonstrate our commitment to these standards and behavior, all

employees must abide by the following no-gift policy requirements.

 No gifts of any kind that are offered by (current or potential): vendors, suppliers,

customers, or any other individual or organization, no matter the value, will be

accepted by any employee, at any time, on or off the work premises. This list also

includes people who are potential future employees of _________ [NAME OF

COMPANY]. By “gift,” this company means any item including pens, hats, t-

shirts, mugs, calendars, bags, key chains, portfolios, and other items, as well as

things of greater value.



--This “no-gift” policy includes vendor- or potential vendor- or supplier-provided

food, beverages, meals, or entertainment such as sporting events.



--This "no-gift" policy includes any business courtesy offered, such as a product

discount or any other benefit if the benefit is not extended to all employees.



Gift Policy Exceptions:



--Exempted from this policy are gifts such as t-shirts, pens, trade show bags and

all other items that employees obtain, as members of the public, at events such as

conferences, training events, seminars, and trade shows that are offered equally to

all members of the public attending the event. This includes attendance at and

food, beverages, and items provided at events, exhibitor trade show floor

locations, press events, and parties funded by conference or event sponsors.



--Exempted are cards, thank you notes, certificates, or other written forms of

thanks and recognition.



--Exempted are food, beverages, and moderately priced meals or tickets to local

events that are supplied by and also attended by current customers, partners, and

vendors or suppliers in the interest of building positive business relationships.

This moderately priced entertainment is provided as part of a “working” meeting

or session to benefit and advance positive working relationships and company

interests. These activities are expected to be reciprocated by our company in turn.

"Moderately-priced," within the meaning of this policy, refers to values less than
