This document contains additional terms and conditions and is incorporated into a plumbing subcontractor agreement. The terms and conditions listed in this schedule are rights and responsibilities of the parties that were not included in the main contract. This ancillary agreement includes provisions regarding cleaning the premises prior to the work, hazardous materials, insurance, and compliance with industry standards. It can be modified to address the specific needs of the contracting parties. This document should be used in addition to the main contract when parties enter into an agreement for plumbing services.

This document contains additional terms and conditions and is incorporated into a

plumbing subcontractor agreement. The terms and conditions listed in this schedule are

rights and responsibilities of the parties that were not included in the main contract.

This ancillary agreement includes provisions regarding cleaning the premises prior to

the work, hazardous materials, insurance, and compliance with industry standards. It

can be modified to address the specific needs of the contracting parties. This document

should be used in addition to the main contract when parties enter into an agreement for

plumbing services.

PLUMBING TERMS AND CONDITIONS

The Plumber shall have access to the premises for the time period agreed upon by the

Plumber and the Owner of the premises for the plumbing services to be performed by the

Plumber. The Owner shall ensure that no other contractors or tradesmen will be working on

premises at the same time as the Plumber is performing the plumbing services.



Any and all work and plumbing services to be performed by the Plumber shall be carried

out in a professional and workmanlike manner and shall be performed in accordance with

industry standards and laws of the applicable jurisdiction.



The Owner of the premises shall ensure that the area of the premises where the plumbing

services are to be performed will be free and clear of any and all debris prior the Plumber

commencing the plumbing services. Should the Plumber at any time or times find that such area

is not accessible for the performance of the plumbing services and/or is unsafe, the Plumber shall

cease all plumbing services to the Owner at the premises until such time that the area of the

premises to be serviced is free and clear of debris and is safe for the Plumber to perform the

plumbing services.



The Plumber requires that the Owner clean the area of the premises to be serviced by the

Plumber prior to the commencement of plumbing services. Should the Plumber be required to

move any items, furniture or possessions, the Plumber shall remove such items, furniture and

possessions at the Owners own risk. At no time or times, shall the Plumber remove any asbestos

or other hazardous materials from the premises.



Any damage repair or preparation work to be performed by the Plumber shall be invoiced

to the Owner.



The Plumber shall not at any time or times be responsible or liable for any existing

structural damage at the premises while performing the plumbing services.



The Owner shall remove and/or protect all of the Owner’s personal property inside and

out, including but not limited to, carpets, draperies, rugs, furniture and other personal property of

the Owner.



Any and all equipment and materials for the performance of the plumbing services to be

performed by the Plumber shall be provided by the Plumber.



The Plumber shall be solely responsible for the payment of any and all wages and salaries

that may be due or become due and owing to any of the Plumber’s employees for plumbing

services perform by such employees at the premises. The Plumber shall also be solely

responsible for the collection and remittance of any mandatory deductions from the wages and

salary of an employee of the Plumber.



The Plumber shall at all time or times, maintain general liability and Worker’s

Compensation insurance in an amount to be determined by the Plumber for the plumbing

services to be performed. The Owner shall at all time or times, maintain insurance on the

premises in an amount that is acceptable to the Plumber. All such insurance shall be kept in full

force and effect until the plumbing services are complete.



The Plumber shall perform all of the necessary work in respect of the clean up and

disposal of all plumbing related debris from the premises upon completion of the plumbing

services.



After the plumbing services have been commenced by the Plumber, should any event

occur that may directly or indirectly prevents the Plumber or delays the Plumber from

performing the plumbing services over which the Plumber has no control, the Owner shall

immediately pay to the Plumber the full amount of all plumbing services provided.



Any sewer, gas or water piping lines shall be stubbed out in accordance with the laws of

the applicable jurisdiction, prior to the Plumber’s commence of plumbing services.
