This is an agreement that is entered into between the roommates of a dwelling that sets
out the rules and responsibilities of each roommate. This agreement specifies the rental
amount each roommate is accountable for, cleaning responsibilities, overnight guest
policy, and much more. This agreement can be used by individuals that have
roommates and want to provide a document that clearly establishes the rights and
obligations of each party.
ROOMMATE AGREEMENT
This Roommate Agreement (the “Agreement”) is made on this ___ day of
_____________, 20___ [Instruction: Insert Date] (the “Effective Date”) by and between
__________________ [Instruction: Insert Roommate 1 Name] (“Roommate 1”) and
___________________ [Instruction: Insert Roommate 2 Name] (“Roommate 2”), collectively
referred to herein as the “Parties.”
RECITALS
WHEREAS, Parties have entered into a Lease Agreement (the “Lease”) together with
___________________ [Instruction: Insert Landlord Name] (the “Landlord”) dated the _____
day of ___________, 20___ [Instruction: Insert Lease Date] in respect of the rental premises
located at _____________________ [Instruction: Insert Address] (the “Rental Premises”); and
WHEREAS, the Parties desire to provide for the equal sharing of all responsibilities and
costs of leasing the Rental Premises.
NOW, THEREFORE, in consideration of the mutual covenants contained herein and
other good and valuable consideration, the receipt and sufficiency of which is hereby
acknowledged, the Parties hereby agree to the following terms.
TERMS
1. TERM AND TERMINATION
A. The term (the “Term”) of this Agreement shall commence on the Effective Date
above, and shall continue in full force and effect until the end of the term of the Lease or until
either of the Parties has vacated and found a suitable replacement roommate pursuant to
Paragraph 1(B) hereto.
B. The Parties hereto hereby acknowledge and agree that the Lease provides for a

Parties hereby agree that each of them shall provide at least ____ (___) days’ advance written
notice to the other in the event one of the Parties intends to vacate the Rental Premises (the
“Leaving Party”) prior to the end of the Lease. The Leaving Party shall use its best efforts to
find a suitable replacement roommate for the remainder of the term of the Lease. Should the
Leaving Party be unable to find a suitable replacement roommate prior to the date the Leaving
Party intends to vacate the Rental Premises, the Leaving Party shall be responsible and liable for
all of the terms and conditions of the Lease, until such time as a suitable replacement roommate
is found and shall be responsible for the Leaving Party’s portion of all rent due and owing to
Landlord.
2. PAYMENTS
A. Security Deposit
The Parties hereto acknowledge and agree that a security deposit in the amount of

Parties to Landlord upon the execution of the Lease. The Parties acknowledge and agree that
each Party shall be solely responsible for any and all damages caused by each or by the guests of
each. Should any damage occur to the Rental Premises where the cause cannot be determined,
the Parties hereby agree to divide equally the cost of any and all repairs required.
B. Monthly Rent
The Parties hereto acknowledge and agree that each of them is responsible for
monthly rent as follows, payable to the Landlord in accordance with the terms of the Lease.

C. Utilities
The Parties hereby acknowledge and agree that all utilities in respect of the Rental
Premises shall be divided equally between the Parties and paid when such utilities are due.
3. CO-HABITATION
A. Cleaning
The Parties hereby agree that each Party shall be equally responsible for cleaning,
maintaining, and tidying the Rental Premises (including household duties such as taking out the
trash, etc.). The Parties hereby acknowledge and agree that they shall divide equally between
them, all costs for household supplies, including but not limited to, cleaning supplies, toiletries,
and personal hygiene products such as toilet paper. The Parties shall give written notice of any
concerns about cleanliness to each other in a polite and professional manner. If a Party fails to
repair the condition within ____ (___) days following receipt of such notice, said Party shall be
in breach of this Agreement. In such a case, the non-breaching Party may hire a cleaning service
to remedy the issue and require the breaching Party to pay for such services within ____ (___)
days of receipt of invoice for same. Repeated violation of this provision shall be considered a
material breach of this Agreement.
